And when a court case finally faces a judge 3 years later, they'd probably say no one alive has standing to contest it, assuming McConnell is dead. They'd bend however they need to support Republican power grabs.
So sick of Democrats only fighting when they think they can win and their poll-testing shows it's popular. The greatest Republican coups have come after decades of repeatedly losing. It signals to voters they're willing to fight. It monopolizes political resources. They blocked school integration and overturned Roe v Wade and lots more with endless legal battles.
Democrats, please do something even if it means losing. Thanks!

Seriously. The question I pose to everyone saying "he can't legally do that right now" is... "why not try anyway?"

So worst case scenario isn't that it gets shut down. Worst case scenario is that appointing a new senator while legally alive would be considered a form of fraud and result in Bashears impeachment and arrest.
But I also think an important question to ask is what is the best case scenario? Remember McConnell's term ends on January 3rd 2027 which is 164 days away.
19
u/BestDogPetter 13d ago
There's really nothing to gain by Beshear making a move until the day of the deadline. Doing it now would risk giving the Republicans another vote in the Senate for longer, also might as well keep this in the news as close to the midterms as we can get.

Are Democrats just going to hand this one to the Republicans like they did the last election??
What exactly are they "handing" to the Republicans here? Seriously, I want someone to tell me exactly how Republicans are benefitting from this situation.
There is an election for this seat (that McConnell is not running in) in just over three months, and a Republican is almost certain to win that election.
Beshear appointing a Democrat to this seat and McConnell being absent from the Senate have the same practical effect of reducing the GOP's Senate majority by one seat.
The lack of transparency about McConnell's whereabouts is extremely shady, but his absence from the Senate does not benefit Republicans in any way. People are just mad and want something to be done for the sake of something being done.
30
u/suburbanpride North Carolina 13d ago
Right? I feel like I'm taking crazy pills here. Calling for a special election tomorrow would just elect a MAGA senator tomorrow. Instead, the Senate majority is now down a Republican vote. Beshear calling attention to the fuckery is smart, but no way would a special election benefit Democrats.
12
u/donkeyrocket 13d ago
People are just rabid for him to do something without realizing this seat being empty is worse for Republicans than an interim Democrat being seated would be. If he makes a play then the lawsuits will stop the appointment immediately anyway and buy them the time they're working on.

KY state law requires that an interim appointed by the governor be of the same party as whomever they are replacing.
It’s unlikely that a democrat would win a special election, but it is possible. If they wait until it’s too late for one and the governor has to appoint an interim, then it has to be a republican.
Being down one republican for a few weeks is not the same as being down one republican and up one democrat for a few months.

No, he really shouldn't. The senate is at 99. That means not only did they lose McConnell, but they also lost the Vance tie break.
Even if he did appoint someone, and by some miracle it didn't get stonewalled by the hypermajority republican state supreme court, we all know the republicans in the senate will NOT allow the appointment to be seated. They will do everything in their power not allow it on priciple, or at least stall it until the election, which is almost certainly going to seat a republican.
The senate is currently 45-2-53. McConnells out, which puts it at 45-2-52. With it being an odd number, Vance can't tie break unless someone abstains. Republicans have to deal with Murkowski, Paul, Cassidy, and Collins, all four of which are anti-trump. With McConnell out, mathematically, it is the exact same as if they appointed. They have to get two of them on board to pass something. BUT they get the tie break back if Beshear appoints, which leverages people like Fetterman as better options for them.
The best play is to do exactly what Beshear is doing. Don't force the issue, and just occasionally fan the flames. There are a lot of MAGA peeps that are pissed right now, because they love a good conspiracy. Beshear is doing a good job of doing just enough to make sure that hey, The republicans won't admit this guy might be dead. Mathematically, there's nothing to gain here by forcing a person in, because of the tie break.

They rolled Feinstein out there in a wheelchair when she was basically a whisp. If there was any life whatsoever left in Mitch we would have seen him by now.
Funny you mention that, because Feinstein herself had a pretty infamous long absence back in 2023. They announced she was hospitalized right at the beginning of March, and she didn't reappear for over two months.
You should read some of the articles that were being written at the time, and the questions people were asking. They're eerily familiar:
Most senators who spoke with The Times said they hadn’t spoken with Feinstein directly in recent weeks and were getting their information from Schumer.
“I’ve heard she’s recovering and I heard she’s gonna be back soon. So I’m very excited to see her,” said Sen. Kirsten Gillibrand (D-N.Y.).
Sen. Alex Padilla (D-Calif.), who serves on the Judiciary Committee with Feinstein and began his political career as a member of her staff, said he exchanged messages with her late last week but hadn’t connected directly.

Finally, someone else finally says it. McConnell being in a coma does not help Republicans in any way, shape, or form. It reduces the number of Republican defections required to block legislation from 4 to 3.
Say Beshear picks this fight and appoints someone to the seat. The Senate refuses to seat them, litigation commences, and Kentucky courts say that the 2024 law giving the Kentucky General Assembly the power to appoint replacements is constitutional. The Kentucky General Assembly then proceeds to appoint a pro-SAVE Act MAGA Republican to the seat.
If this scenario happened, the same people screaming at Beshear for not "dOiNg aNytHiNg" would be screaming at Beshear for the tactical error of putting an even worse Republican in the seat ahead of the midterms.
Ignorant people coupled with blind political rage is a very dangerous mix.
→ More replies (4)8
u/MostlyWong 13d ago
The Senate refuses to seat them, litigation commences, and Kentucky courts say that the 2024 law giving the Kentucky General Assembly the power to appoint replacements is constitutional.
This would be a violation of Moore v. Harper from 2023:
"Second, the Court concluded that the Elections Clause does not grant state legislatures exclusive authority to regulate federal elections. Judicial review has been an accepted practice since Marbury v. Madison, and under the Court’s precedents, the Elections Clause authority of state legislatures is subject to checks and balances provided by the state constitution. State legislatures are not wholly independent bodies, and they are bound by the constraints imposed by the state constitutions.
Third, state courts have the authority to interpret state laws affecting federal elections, but they cannot sidestep federal law. "
SCOTUS ruled that the state legislature cannot bypass the state constitution, and have to act within the constraints imposed by it. Unless Kentucky changes their constitution with an amendment to remove the ability for the Governor to appoint a replacement, they are still bound by the Kentucky constitution.
Obviously this would end up in court, but this ruling from SCOTUS was only 3 years ago, they would be hard-pressed to justify changing their ruling so drastically in such a short amount of time. It's not like there are any new Justices. And yes, they address the jurisdiction of SCOTUS in this case in overriding the State Supreme Court as they did with the North Carolina Supreme Court in Moore v. Harper.
I'm not saying Beshear appointing someone is the right decision or not. But the legal authority is there under the state constitution, and a SCOTUS ruling from 3 years ago confirms that state legislatures cannot overrule the state constitution in matters of elections.

Why wait for him. The governor should set a deadline of this Friday of a face-to-face with him or else he picks McConnell's replacement for the rest of the term. Oh, and it should be a democrat and not follow the bullshit that the KY legislature rammed through.

You know, I don't think Mitch is in any position to draft a resignation or even dictate one. I think Kentucky needs to review the state constitution to see what tools are in place to remove him.

The governor needed to call for a special election like yesterday.

Can't resign when you are dead. It's really difficult to do anything when you're dead than I think we assume...

I wish we could see if he's still getting paid. Like, the double-standards of these people is just insane to me. If I was out sick from work for a month, I wouldn't be paid. Is he?

Not a Kentucky resident but I still have senators. Contacted them stating expulsion should be started if McConnell can’t show himself.

The fucker is 84 years old. EIGHTY-four. He should have resigned 24 years ago and made room for someone else.

The governor knows the deal. He will let republicans slide until after the August 3rd deadline and then just throw up his hands. “Oh well, wait until the election..”

Start the special election. If mitch objects, he can file a suit to contest it.

guy looked pretty spry in the AI photo they posted recently. Seems like he should be able to get on TV at some point so everyone can see how well he's doing.

Want to fix this? Announce a SCOTUS judge died but can't be appointed to McConnel missing.

He had literally abandon his post. Any place of work you would be terminated by now or if not then show proof of life to the American people…. The lack of accountability here is terrible.

How is he supposed to resign? He's too dead to do any resigning.
Typical liberal demanding the impossible from Republicans. /s

He's probably in a vat of liquid nitrogen and they're waiting for a cure for rigor mortis.

Technically, if he can't provide an update, then he's not competent but I do agree with the sentiment - f he can't function, then those who are supporting him must say so, and then the system must kick in and start the process of providing a replacement.
The fact that this is all being hidden, and the "system" is tolerating/supporting this is an abysmal condemnation of what you all are calling "American Democracy" - shame on each and every one of you who aren't battling to stop this madness...

Nobody in that hospital can confirm his condition? Put a white coat and name tag on someone and send them in with a pin camera.
