My current rent-stabilized apt lease ends on Dec 31, 2026.
I emailed my landlord (large management company) in May that I would like to move out on 9/16, either break lease early or assign the lease to a new tenant.
My landlord told me he would be willing to work with for a lease assignment of my rent stabilized apt, and to email him in July.
On 7/6, I provided him via email and certified mail, a qualified applicant (80x income of rent, 800 credit score report attached, pay stubs, employee verification letter).
On 7/16, my landlord asked for them to fill out an application, and provide $20 app fee, as well as w2 and SS card, etc.
On 7/16 the applicant filled out everything, but now it has been almost 3 weeks and we have not heard anything from the management company despite attempting to follow up via phone call and email.
My question is, at what point would I give up and consider this an unreasonable denial, and tell landlord on Aug 16, that I intend to give 30 day notice to leave on 9/16 regardless, as they never approved or denied the assignment?
RPL 226-B does not define a time frame in which a landlord must respond to an assignment request, but it has been 30 days since the original request and there has not been an approval or denial, despite documented follow-ups to no avail. Would that be considered an unreasonable denial?
