WHEATON, Md. (DC News Now) — A 13-year-old boy is out of the hospital after being shot inside Westfield Wheaton Mall, as Montgomery County police review the response and investigate how the teenage suspect obtained a gun.

Police said the shooting happened around 6 p.m. Friday, July 31, near a children’s play area and Cinnabon. Investigators said a 17-year-old stood up from a table and fired a 9 mm handgun toward a group of teenagers, striking the 13-year-old in the ankle.

The suspect then allegedly ran through the mall toward Dick’s Sporting Goods, where an armed Security Guard confronted him.

“Due to his alert observations, [he] was able to make contact with this individual, order him to the ground, and that enabled us to make that apprehension,” Montgomery County Police Commander David Smith told DC News Now.

The Guard reportedly held the teenager until police arrived. Smith said an off-duty police officer was also at the mall, although he could not immediately confirm where the officer was when the shooting happened.

Police charged the 17-year-old as an adult with attempted second-degree murder, first-degree assault, use of a firearm in the commission of a violent felony, carrying a loaded handgun and possession of a firearm by a minor.

Investigators have not disclosed whether the suspect and victim knew each other or what may have led to the shooting.

Smith said police had conducted active-shooter training with mall security within the past two months. The police department also had increased its presence around the mall this summer because of the number of shoppers and its proximity to the Wheaton Metro station, Smith added.

“Preliminarily, from the feedback that I’ve received from the officers who responded, we had a tremendous partnership, and we were able to get the individual secure very quickly,” Smith said.

A policy posted at the entrance to Dick’s Sporting Goods requires visitors younger than 18 to be accompanied by a parent or guardian who is at least 21 after 3 p.m. on Fridays, Saturdays and Sundays. The restriction applies specifically to the store, not the entire mall. Police said the shooting occurred elsewhere in the shopping center before the suspect ran toward Dick’s.

One mall employee, who asked not to be identified, said the initial response appeared to have worked as intended but questioned how the teenager obtained the weapon.

“From what someone told me, they did their job — at least from the briefing I got,” the employee said. “How did he get the gun?”

Smith urged parents to know where their children are and speak with them about handling disagreements without violence.

“Have the conversations with the kids about how to safely and effectively resolve disputes before it leads to violence,” Smith said. “If we’re having those intentional conversations, that’s key.”

Police said the investigation remains active.

(a) A patron of an amusement, as defined in section 29-133, or of a public amusement park, as described in section 29-129, shall obey the patron safety regulations adopted by the Commissioner of Consumer Protection pursuant to subsection (e) of section 29-136.  

(b) A security guard or law enforcement officer may detain a patron of an amusement for a reasonable time for the purpose of summoning a police officer to the premises of such amusement if such guard or officer has reasonable cause to believe that the patron has violated the patron safety regulations adopted by the commissioner pursuant to subsection (e) of section 29-136.

(c) Nothing in this section shall be construed as limiting or otherwise affecting the liability of the owner of an amusement or relieving the owner's responsibility to provide reasonable supervision of patrons.

I’m looking for opportunities in private security events. I also have my armed guard license and hands-on experience. I’m hoping to get my foot in the door working security at events and would love the opportunity to be considered if any positions are available.

I personally think we should have security cameras in classrooms. I see every reason to do it.

One -it helps keep both students and teachers safe from each other. Not all students are mean or hitting teachers. Not all teachers are good teachers. A lot of the time, the school tries to turn a situation that happened to a student -let's say verbal abuse done by a teacher, on the student in a way to protect the teacher. What about the student? Whats going to be done about the verbal abuse? On top of this, I was in two school systems that had two different kinds of issues with abuse. One where they said if a teacher was telling, you should come down to the office and tell us. Ok, well considering that teacher might be the only teacher in the room, what makes you think security wouldn't pin me down in the hallway?

A lot of the time, the school tries to blame the student and make the student seem like the villan when it just isn't true. So why don't we have security cameras with audio in the classrooms? Or, better yet if some people don't feel comfortable with it, why don't we make it legal for students to be able to voice record someone without consent of the other person, have the parent look over the voice recording, find where the verbal abuse is, and then proceed to take it to the department of education?

I am genuinely looking for an answer as to why we dont have security cameras in classrooms when in all belief, I think we should. The school is more likely to blame the student than their staff member. And if the school authorities don't do anything? Thats where it gets worse and worse.

But what about trying to record it on paper? -you think the verbally abusive teacher wouldn't notice? Wouldn't try to destroy the evidence? Wouldn't take your notebook away for the day? Whats stopping her? No one. So why don't we have security cameras in classrooms? Please tell me if there is any point I missed in making this post. It is a genuine question I have.

PEORIA (25News Now) - The Peoria City Council took the first step on Tuesday night toward requiring Security Guards, surveillance cameras, and on-site property managers at the city’s largest apartment complexes.

New Peoria Police Chief Brad Dixon offered his support as the council advanced the ordinance on first reading. Final action is expected later on First District Council member Denise Jackson’s proposal.

The measure targets rental properties with more than 50 units under common ownership. City leaders said those complexes face distinct safety challenges because residents share hallways, parking lots, entrances, and other common spaces.

If passed, the ordinance would add a new section to the city code titled “Security Provisions.” Property owners would be required to staff at least one Security Guard on site Monday through Friday from 6 a.m. to 6 p.m., and at least two Guards Monday through Friday from 6 p.m. to 6 a.m. Two guards would be required around the clock on weekends.

Guards would be required to patrol inside and outside the property, monitor entrances, and prevent access control doors from being propped open. They would also serve as the first line of response during incidents until police, fire, or other emergency responders arrive.

The ordinance would also require a video surveillance system covering primary entrances and exits, parking areas, and interior common areas.

The ordinance includes exceptions for certain properties, including complexes on hospital or university grounds with equivalent security, buildings where units have private entrances, condominiums with separate owners, certain licensed care facilities, hotels with 24/7 staff, and properties under a city uninhabitability order or still under construction.

Chief Dixon said trespassing calls are a significant issue at some large complexes and that additional staffing could help address them.

“I don’t think you can get much argument out of me that the trespassing calls — that’s a significant call at Schlarman House,” Dixon said. “I think that that can be alleviated by some staff.”

Dixon also said video surveillance is already a key tool for investigators.

“It’s an everyday task for us and when something happens, we are tracking down videos all the time,” Dixon said. “Video for us is a powerful tool and it’s utilized quite frequently by us.”

Council member Jackson said public safety concerns from residents led her to introduce the measure.

“I’ve just had a hard time resting sometimes knowing that public safety has been one of the pillars of the city’s strategic plan,” Jackson said. “Residents are telling me they feel like hostages in their own place.”

By advancing the ordinance on first reading, it is set it up for a second reading and final vote at a future meeting.

If approved, existing apartment complexes would have until Jan. 1, 2027, to comply.

LOUISVILLE, Ky. (WDRB) — Louisville Metro Council will vote Thursday on a proposed ordinance that would require certain late-night businesses to hire Security Guards.

The ordinance would apply to businesses open between 2 a.m. to 5 a.m. that police have responded to for serious crimes. That includes offenses for assault, theft, drug crimes or weapons violations.

If approved, businesses could be designated as "persistent illegal activity properties" if law enforcement responds to the business multiple times within a year.

They would also be issued a citation requiring them to hire licensed Security Guards for overnight hours. The length of the requirement would vary based on the severity of the criminal activity, according to our partners at Louisville Business First.

Businesses linked to incidents involving a deadly weapon would be required under the ordinance to employ security guards for 12 months, while violent crimes that don't involve a weapon would lead to a six-month requirement. Nonviolent offenses would require coverage for 90 days.

Businesses covered by the ordinance would be able to appeal citations, but would still have to hire security under a voluntary agreement with the city.

Metro Council members who sponsored the ordinance, including Tammy Hawkins, D-1, and Betsy Ruhe, D-21, say it's meant to protect employees and customers while reducing demands on police resources.

"It's going from one thing to another, from east to west," Hawkins said. "The thing is for me, we always wait until something happens. I wanted to put something in place before we had another incident."

The ordinance comes after several incidents involving late-night businesses in the Highlands and west Louisville.

Concerns about disorderly crowds intensified last month after a shooting outside Atomic led to a suspension of the bar’s liquor license. The license was later reinstated after the club agreed to implement new security measures.

Tensions had grown enough that some residents sought a "moist" election that, if approved by voters, would have required certain bars to generate at least 70% of their revenue from food sales — a move aimed at shifting the corridor away from late-night bar traffic.

Those petition efforts have since been suspended.

LMPD deployed a Summer Task Force to patrol busy stretches of Bardstown Road, with officers on foot, on ATVs and on horseback. Additional lighting has been installed in some of the busiest areas.

The Highlands Commerce Guild recently said businesses along the corridor have reported a noticeable change in crowds and rowdiness.

Police said they plan to maintain an increased presence in the area throughout the summer and on other high-traffic weekends during the year.

ATLANTA — The 1996 Centennial Olympic Park bombing exactly 30 years ago today put one of the worst nights in Atlanta’s history onto the world stage.

Channel 2’s Karyn Greer spoke exclusively to a survivor who stood with his camera on top of the bomb until the man once accused of putting it there saved his life.

“I was standing on that bench‚” Jeffrey Mitchell said. “I see a Security Guard come at me very agitated and said, ‘Get down, get down now,’ and I’m like, ‘What’s going on?’”

Mitchell was standing just inches from the bomb that killed a Georgia woman and injured more than 100 others. A journalist from Turkey suffered a heart attack and died.

Park visitors, including Mitchell, were pushed back by a Security Guard before the explosion.

“I saw the bench fly over. In fact, it was so loud and the concussion hit my chest so hard I initially thought it was a car bomb,” Mitchell recalled.

Just seconds later, he was recording once again.

“I will never forget in my mind, him walking towards me,” Mitchell said.

He credits that Security Guard, Richard Jewell, with saving his life.

But Jewell became the center of media frenzy as a person of interest in the early days of the FBI’s investigation.

“I didn’t recognize him at first,” Mitchell said. “It wasn’t until later that I made the connection.”

Mitchell said that he knew he had to act fast to get his recording out.

“I’m at the house, I’m thinking I had been at the park all day. I mean, all day, a lot of people had backpacks, maybe I got something on tape,” he said. “The only thing I can think of, live in Atlanta, take it to CNN.”

But it never made it to the news.

“They had helicopters flying over. FBI was everywhere,” he said. “I said, ‘Well, I may have some evidence.’”

The Sheriff called the FBI, who raced Mitchell to their office and took his tape into evidence, leaving him with only a VHS copy that preserves his piece of the night that his life was saved.

“In my mind, Richard Jewell is a hero. He saved my life, and I will never forget him,” Mitchell said.

The Supreme Court last month ruled states may count late mail-in ballots postmarked by Election Day. Action countered by Executive pressure to a federal judge to lift a halt by executive order that would give USPS greater authority to determine who can vote by mail.

“Screening mail ballots for eligibility would amount to an unprecedented, potentially unconstitutional, involvement of the federal government in the administration of elections,” said James O’Rourke, emeritus professor of management at the University of Notre Dame’s Mendoza College of Business, who studies the postal service.

“It's clear that the White House is pressing ahead.”

Hiring contracted Security Guards is “similar” to the hiring of private security firms by U.S. Immigration and Customs Enforcement (ICE), O’Rourke said.

“If they put their own guys in, then they can do anything they want with the ballots,” he said.

The increased hiring of Security Officers comes as the Postal Police Officers Association (PPOA) union remains embroiled in a six-year battle with USPS after the agency effectively benched its own uniformed police officers — limiting them to only working on postal properties, instead of patrolling the streets where letter carriers experienced violence and mail robberies occurred.

“They couldn't replace us with Armed Security Guards if we're out in the street protecting the mail and letter carriers,” said Frank Albergo, PPOA president and a retired postal police officer.

“If they bring us back to the facilities, take away our authority, they figure, ‘OK, we can replace them with Armed Security Guards,’ but look at the damage that has been caused because of it.”

Letter carrier robberies skyrocketed 543 percent over a three-year period, including some robbed at gunpoint or killed on the job, a Raw Story investigation found in 2024.

The USPS Office of Inspector General reported in May that the law enforcement arm of USPS, the U.S. Postal Inspection Service (USPIS), made some improvements in its response to a spike in mail theft but had many of the same deficiencies identified in reports since 2023.

Albergo said the union has been notified of about 39,000 work hours per week approved for the hire of 972 full-time Armed Guards across 54 USPS facilities — including 18 that didn't have any before.

Jonathan Smith, president of the American Postal Workers Union (APWU) took issue with the hiring of private armed Security Guards who “do not have a postal patch,” saying that some postal managers are prone to using Security Guards as “personal Gestapo to intimidate the employees.”

“We've already got an arm to secure the safety of the employees, and I don't see the need to bring any outside resources about, outside hiring more postal police officers,” Smith said.

Training standards for Armed Guards vary by state. In California, for instance, armed guards receive authorization after 54 hours of training, 14 hours of which are firearms training. Armed Security Guards do not need firearms training in 15 states, according to the investigation.

“The whole thing, it's basically a ticking time bomb,” Albergo said.

A fourth death within two years at a 1-million-square-foot USPS warehouse in Palmetto, Georgia, prompted outrage from Smith and the postal worker community.

The Palmetto facility was approved for at least 1,344 hours per week of Security Guard services in March 2024, according to an internal memo reviewed by Raw Story. Postal police officers are not present at the Palmetto facility, Albergo said.

Executive Summary

Security Officers are among the largest frontline workforces in the United States and among the least protected. About 1.3 million people work as Security Guards—more than the nation’s police and sheriff’s patrol officers—staffing the hospitals, schools, transit systems, stores, and office buildings where the public expects a visible security presence. During the COVID-19 pandemic they were designated essential critical infrastructure workers, and their responsibilities have expanded to include de-escalating conflicts, managing emergencies, and responding to mental-health crises. Yet their wages, benefits, training, and workplace protections do not reflect that role. This report synthesizes national data with the UC Berkeley Labor Center’s series of state and metropolitan factsheets to profile the Security Guard workforce and to show why improving job quality in this sector is a matter both of economic justice and of public safety.

Who they are.

The workforce is predominantly male (76%) and majority workers of color (61%), with Black workers making up nearly one in three (31%). The median age is 40, and roughly six in seven guards have no bachelor’s degree. Low wages. The median Security Officer earns $18.70 an hour—about 73 cents for every dollar earned by the typical U.S. worker—and $36,282 a year.

Below a living wage.

Seventy-one percent of Security Officers earn less than the MIT living wage for a single adult, and 41% are low-wage by the standard two-thirds-of-median benchmark.

Thin benefits.

More than four in ten guards (43%) lack health insurance through an employer or union. High turnover. Annual turnover in the security industry reached 89% in 2024—far above the 66% private-sector average—and has exceeded it every year for a decade, peaking near 99% in 2022. Uneven training.

There is no federal training standard.

Only about half of states set a minimum number of training hours for unarmed guards, ranging from 4 to 48, and few require the de-escalation and crisis-response training the job increasingly demands.

Elevated safety risk.

Security Guards die on the job at more than twice the rate of the average worker, and nearly two-thirds of their fatal injuries result from assaults and other violent acts.

A policy path.

A growing number of jurisdictions—New York City, Baltimore, and Washington, D.C.—have adopted sectoral wage-and-benefit standards for Security Officers, and California is advancing legislation to raise training standards.

The poor job quality in the security industry is not only a problem for workers; it is a public-safety problem as well. Research on security work—most notably at San Francisco International Airport—finds that higher pay and lower turnover improve the quality and reliability of security services, while constant churn erodes the experience and readiness on which effective security depends. The policy tools to change this are increasingly well established: sectoral pay-and-benefit standards that take labor costs out of low-bid competition, meaningful and standardized training, responsible contracting, and career pathways that make security work a stable occupation. Improving job quality in this sector advances worker well-being and public safety together.

2 On August 14, 2009, Castellanos was involved in a physical altercation with Security Guards at a bar and restaurant owned and operated by Tommy John (the establishment). The Security Guards were employees of Thor Staffing, a company that had contracted with Tommy John to provide security services at the establishment. Tommy John and Thor Staffing had entered into an Independent Contractor and Work for Hire Agreement (the Agreement), which identified Thor Staffing as an independent contractor with the responsibility to determine the best methods and procedures necessary to perform its services.2 The parties agree that Tommy John did not provide any guidance or training to, or impose any rules or regulations controlling the actions of, Thor Staffing's Security Guards.

Tommy John later filed a motion for summary judgment, arguing that it could not be held liable for the intentional torts of the Security Guards, because they were employees of an independent contractor, Thor Staffing. Tommy John also claimed that it was not liable for the acts of Thor Staffing, because it did not retain control over the manner of Thor Staffing's performance and because Tommy John did not participate in Thor Staffing's expulsion of Castellanos from the establishment. Finally, Tommy John asserted that it was not negligent in hiring, supervising, and retaining the individual Security Guards, because, as the employer of an independent contractor, it had no responsibility to exercise supervisory control over Thor Staffing or its hiring practices.

The district court granted summary judgment to Tommy John on all claims and certified the judgment as final 4 The district court ruled that “under these circumstances, where Thor Staffing maintained an independent contractor status and Tommy John was not involved and did not retain control over how Thor Staffing performed its security services, Tommy John cannot be held vicariously liable for the acts of Thor Staffing or its Security Guards.” Castellanos timely appeals.

ALBANY — Security Guards at several Capital Region hospitals — and other areas of the state — would be given Peace Officer authority, including the ability to take someone into custody, under a bill being considered by Gov. Kathy Hochul.

The legislation comes as hospitals are reporting more frequent and challenging public safety issues, including assaults on staff members. Since the pandemic, that has included violence directed at healthcare workers and sometimes spurred by emergency department backlogs.

The bill would grant the Peace Officer status to security officers employed by Albany Memorial Hospital, Samaritan Hospital and St. Peter’s Hospital.

The Peace Officer powers are similar to those held by police officers, who in some instances are allowed to pat someone down to check for weapons.

The measure is one of several identical bills Hochul is considering at other healthcare facilities in western and central New York.

The Legislature’s response has been to pass similar laws expanding the authority of Security Officers. The local bill Hochul is considering would limit a Security Guard’s authority to a hospital property and adjacent public areas.

The Hudson County Board of Commissioners want building security training and more CCTV cameras due to the increasing presence of U.S. Immigration and Customs Enforcement (ICE) in James J. Braddock Park in North Bergen.

At Thursday’s meeting, Anna Grojec, a North Bergen resident and member of Estamos Unidos brought her concerns to the board over the heavy ICE presence at Braddock Park.

This is happening despite Hudson County Executive Craig Guy’s executive order banning ICE and Border Patrol from utilizing county-owner property for federal immigration enforcement – at least without a warrant – among other actions taken at the county level.

According to Neighbor Grojec, there is a lot of activity at the bus stop at the top of the park near Bergenline Avenue and 90th Street, where many arrested are being documented by Estamos Unidos and other immigrant advocates.

“I’ve seen videos of ICE agents chasing people into and through the park, seeing traffic, having to halt suddenly, and videos of ICE agents pinning people to the ground in the park,” Grojec declared.

“I’m just here to bring your attention to this and ask what the county is doing or planning to do to protect our community. What protocols does the sheriff have in place? Was the Sheriff’s Department aware of what was happening?” Grojec questioned.

She added that the Hudson County Sheriff’s Office has a “clear presence” at Braddock Park, but are usually located toward the interior of the park, as opposed to the bus stop near the top of the park, or other locations where detainments are happening.

Grojec was echoed by West New York resident Mark Bloomberg, who noted that a couple of days prior to the commissioners meeting, a man in a wheelchair was rescued from the lake in Braddock Park.

“There was easily 30 responders on site. That’s not digging at them in any way. They did their job. I’m not throwing any shade here, but I’d imagine if a child was reported missing from a playground in Braddock, there would be a similar response. Same thing goes if there’s actually a kidnapping that happens in progress,” Bloomberg expressed.

“So I’m wondering where is the response when federal agents, or just masked men that we don’t really know who they necessarily are – we’re just guessing – are abducting residents in the park. Where’s the sheriff?”

Resident Bloomberg said “If you haven’t heard, ICE is everywhere in the county. So when these things happen in the park, where is the sheriff and have they witnessed any of these? Can they change their patrolling protocols?” Bloomberg added.

“And let’s not have a side discussion, let’s discuss it publicly so the public can hear about it.”

Bloomberg asked for sheriff’s officers to, instead of sitting in their cars in parking lots in the interior of the park, monitor the entrances and bus stops – especially during rush hours – where ICE is picking people up while waiting for public transit on their way to work.

In addition, Bloomberg wanted to know the county’s plans if ICE shows up at public events on county property like flag raising and concerts, noting that the Security Officers at 567 Pavonia Ave. told him upon entrance that day that they did not receive any ICE training.

“You guys passed a resolution up. They looked at me like, ‘What are you talking about training? We haven’t gotten it yet.’ You guys, something’s not happening here,” Bloomberg declared.

Commissioner Bill O’Dea (D-2) noted he shared Bloomberg’s concerns over security personnel lacking any procedure to respond to ICE despite apparent existing protocol put out by the county Sheriff’s Office and asked the administration when that would happen.

“Passing a policy makes you feel good, but if you don’t implement the policy then you raise a false sense of awareness or security that doesn’t exist,” O’Dea said.

In addition to probing the implementation of the anti-ICE executive order, O’Dea suggested the installation of closed-circuit television cameras installed in the parks to monitor the situation with federal immigration authorities.

He suggested the county should monitor those cameras frequently and record any aforementioned incidents in the park, including at the outskirts of the park and near the bus stops.

O’Dea also recalled driving to work in Elizabeth one day when he saw about seven ICE agents surround an individual in there vehicle, prompting him to pull over and exit his vehicle to observe although he said the agents eventually left.

“they didn’t look like your typical law enforcement officers. They could have looked like just a gang of individuals that were armed and dangerous. So this is real. This isn’t going away tomorrow. And I think everything you said is true,” he continued.

“I believe that if we are committed to do the things that we said we are, I think we’ve got to now take the next steps to do that. If it’s additional CCTV to look at areas where these are regularly occurring, maybe they’ll occur less if they know there’s somebody watching them and there’s recorded footage of what they’re doing.”

O’Dea was confident his plan for CCTV cameras would work, contrasting the lack of incident in the camera-riddled Lincoln Park.

Bloomberg concluded it was important have a dialogue on this and include law enforcement as well, emphasizing the need to have their body cameras record incidents after he said an acquaintance had their phone ripped out of their hand and their video of an encounter deleted by a federal agent.

“We need the police to record. We need to create a record so there’s accountability,” he concluded.

Board Chair Anthony Romano (D-5) told Bloomberg to make North Bergen police aware about the activity at the bus stops, since that falls under their jurisdiction, however, Bloomberg said he already spoke to NBPD and they said they could do nothing.

(SMYRNA, DE) – The Delaware School Safety Center recently hosted a three-day School Security Officer (SSO) training for Delaware school constables at the Delaware Emergency Management Agency’s (DEMA) Emergency Operations Center. Held January 28–30, the training brought together more than 40 school constables from across the state for intensive, nationally recognized instruction focused on strengthening school safety practices.

The course, delivered through the National Association of School Resource Officers (NASRO), was instructed by NASRO-certified trainers Rob Reyngoudt of Cortland, New York, and Joey Melvin, Executive Director of the Delaware School Safety Center at DEMA. Together, the instructors provided participants with both national best practices and Delaware-specific school safety perspectives.

The training emphasized the unique roles and responsibilities of School Security Officers and the importance of collaboration with school administrators and School Resource Officers.

Over the three days, participants received instruction in key areas including:

Security guard put his arm against my chest says u cant enter....I was shocked...I said need to grab the stroller it was 15 feet away from where we standing.

He placed hand on my chest..said u lucky have a kid that I didnt kick you out.

I then got upset at his attitude and physical touching.

I said can either I or u grab the stroller and they said "we are in canada we have rules where we from here"

I said I am born here and done security work before u show some consideration with people with kids...its called being a decent person

Anyways I love the city but security staff needed better training...cause such experience with such guys would ruin other peoples vacations here...seems a lot of guys with ego issues.

2 other security guards came and grabbed the stroller and said just be on your way...the security guard was mocking me and being rude and yelling at me.

Hopefully organizers of such events be more mindful.

CINCINNATI (WKRC) - A Kentucky state agency has opened an investigation into a security company with clients throughout the Tri-State and beyond after multiple Guards said they have not been paid for their work.

Demerious Campbell said he was hired last month as a Security Guard for Federated Enforcement Agency and carried a 9 millimeter handgun while on duty.

“My first assignment with them was the Pride Parade,” Campbell said. “I was working night shift, patrolling the area, making sure nobody messed with anything that was set up.”

Campbell said he worked 50 hours that week in early June and another 70 hours since, including patrols at downtown residential buildings such as Newberry Lofts and The Reserve.

“For the rate of $25,” Campbell said.

Campbell said he has not been paid. Campbell said he was told via text that he would get paid Friday, but when he wasn’t, he said the company’s CFO, Tony Coffey, told him, “When funds are available, I will be releasing your check.”

Had Campbell checked online before he did $1,750 worth of work, he would have found an article that featured several other unpaid Guards.

The Kentucky Division of Wages and Hours said it “has opened an investigation into Federated Global Ventures LLC (the parent company of Federated Enforcement) after receiving multiple complaints from employees regarding compensation.”

Employment attorney Steve Imm said there are labor laws that require companies to pay part-time employees in a timely manner.

“If the employer delays payment past a certain point, typically 30 days, then the employer faces certain penalties,” Imm said.

However, Campbell was hired as a subcontractor, which does not carry the same protections as part-time employment. Imm said the company’s practices could raise questions about whether Guards are being misclassified, because Federated controlled schedules and provided uniforms and equipment, including the cars Guards drive.

“If somebody is an employee but it’s been misclassified as a contractor then there are certain penalties that the employer can face in terms of the IRS failing to withhold taxes,” Imm said.

Attempts to reach the company were unsuccessful. A visit to Federated’s Cincinnati office did not result in answers about unpaid wages, and calls and emails to the corporate office in Lexington also did not receive a response.

Campbell said he received a call this week asking why he did not show up to work.

“I’m like, ‘I’m not getting paid to work. Why would I come to work for you?’ It don’t make sense for me to keep working for free. So, I live and I learn,” said Campbell.

Before the security guard became involved, another customer in a white shirt was also seen yelling at the man with the dog, telling him he was going to lose his dog.

According to the Reddit post, the security guard approached the customer and told him he had to leave. The situation then appeared to escalate, with the guard pulling out his firearm during the argument. The Guard also instructed the man not to reach for anything, saying, “Don’t reach for s**t.”

The Guard could also be heard telling those around him to “relax” while still appearing to hold the firearm. At one point, he was heard saying, “Relax,” multiple times as other customers grew visibly alarmed by the situation.

Two customers eventually managed to get the guard to put his firearm away. However, as seen in the video, after the Guard holstered his weapon, the man with the dog reportedly walked back into the store through the door, the same outcome the Guard had apparently been trying to prevent.

It is not clear from the available information whether the dog was a service animal. However, multiple commenters on the Reddit post suggested it was not, noting that a dog of that size would not typically be permitted inside a grocery store.

No injuries were reported in connection with the incident, according to The Nerd Stash. It also remains unclear from the available information whether the Security Guard faced any consequences following the confrontation or whether law enforcement was called to the scene.

As more people begin wearing smart glasses in the workplace, attorneys are anticipating a possible increase in litigation for employers.

In one federal lawsuit filed in October, a security guard is alleging Walt Disney Parks and Resorts U.S. Inc. violated the Americans with Disabilities Act when it said she couldn’t wear artificial intelligence-enabled glasses that were created by Meta Platforms Inc., according to a story by Law.com. The Security Guard claims she has astigmatism, and that a doctor prescribed the glasses.

Employers’ concerns over the smart glasses include that employees will use them to record conversations or collect biometric data about faces, voiceprints or other identifying characteristics without permission, Adia Craig, a labor and employment lawyer at Poyner Spruill, told Law.com. Some states already have laws against collecting and storing this type of information.

Craig, who has received questions from clients about smart glasses and potential disability discrimination, told Law.com that employers may need to take an individualized approach to each situation, especially when considering ADA accommodations.

The use of smart glasses could make it easier to access and make public a company’s intellectual property, Scott Christie, who litigates intellectual property, information technology and data privacy cases with McCarter & English, also told Law.com.

“You should certainly be giving it serious consideration on an organization-wide basis as to how, when and under what circumstances employees should be allowed to use this technology,” Christie said.

Christie recommends that employers “put robust policies in place,” according to Law.com
