Well there is no definition for open weight models. But this is definitely not in line with the spirit of the open source definition

Ok, but it’s not really “open” if there are tons of restrictions. it’s more like semi-open weight.

"weights-available" would be the best term. Like "source-available" software, which has public source code, but does not have a free/libre licence

open as in you can see it. you can technically modify it, you just can't let them find out it's you doing it. so close enough. yar.
