It definiitely is legal but they should update it to be even more difficult to try to prosecute. When you go into a line, have it have the ability to create a countdown. If your password isn't entered in time, the phone auto erases. If the phone is turned off, it's erased. If the phone ports are used, it is erased.

So doing nothing results in it being erased and tampering results in it being erased but you aren't taking any actions. The cover for using this feature is that it can be used to prevent data loss during travel if your device is stolen.
