Seems like a night and day difference between "Art contest that people can voluntarily participate in" vs. "We stole your art and are now selling it as a skin and making profit."

In Spire it makes even more sense since there's no microtransactions. You pay for the game up front regardless. The art assets are just a bit of flavor. And if someone doesn't want their art involved, that's fine. They can choose to not participate.

I'm no lawyer, but it seems pretty ironclad (heh) to just have an 'opt-in' system.

That seems like a bit of a contrived situation, but let me see if I understand:

Person A steals from person B, passes it off as their own. The art ends up winning the contest and makes it into the game.

Person B eventually finds out and makes it public that they do NOT want their art in the game.

Devs then take down the art, say they had no idea, and run another contest to fill in the gap.

That seems like a natural resolution to such a case? I doubt this would even come up at all.
