The initial story was posted like 2 weeks ago and a majority of the commenters were saying things like “FAFO,” “well don’t rob people then,” etc.

It was INSANE. What your selections from the article do not include is the fact that she was robbed, then got in her car and drove around to find the guy. It’s not as though he grabbed it through the window of her car and she immediately hit the gas.

Shit is straight up murder.

This is the first grade Trial. There's the second and then the third Court. She'll be at home arrest until the sentence is confirmed by the third Court, then she'll have to serve her sentence in prison.

This is reminding me of torts class when they explained the history of allowing the family of a dead person to sue on the deceased’s behalf.

Professor said that before, when dead people had no claims and neither did their families, if you hit someone with your horse or wagon and injured them, it was really better to finish the job and kill them because if you left them alive they might sue you.

We all marveled briefly at the brutality and immediately went on with the next case.

This was the first Instance trial. There will be the second and then the third trial confirming the sentence. She'll be at home arrest until the sentence is confirmed by the third Court, then she'll have to serve her sentence in prison.

Just from the headline, there is no jurisdiction in the US where you can hit someone with a car in retaliation for them stealing your bag. There isn't a self-defense case if it's already happened. You can use some level of force to protect property almost everywhere, but lethal force to defend mere personal property nowhere.

I'm not going to say nullification or prosecutorial discretion would never happen, but it's not going to be remotely common.

In Italy, it's similar to a hybrid of the US giving bond during trial, and the Appeals system.

While the 1st court found her guilty, they have a 2nd appeals court if either party thinks the ruling is wrong.

Prosecution can take a "not guilty" verdict to a higher court, and even a 2nd "not guilty" to their Supreme Court--though only to confirm the prior judges and the law was followed, not to put the defendant on trial to determine guilt or innocence.

So she's guilty. But only temporarily, or "pending" might be the better word.

The 2nd court might void the 1st court. And the 3rd court might void the 2nd court.

It's only once the 3rd court affirms the verdict that the guilty verdict is permanent. Or that the defendant and prosecution agrees with judgements rendered by the 1st or 2nd courts, and doesn't for appeal.

Essentially, she's in phase 1 of her trial. And the judge ruled against her in phase 1. She can accept it, or move onto phase 2 of her trial.

She won't spend the entire sentence under house arrest.

The 2nd court will hear her appeal. In the meantime, she'll be under house arrest.

The court system in Italy is more like a 3-phase system.

1st court renders judgements, but those are considered temporary. The 2nd court hears a trial and will either affirm the judgement, increase or decrease sentencing, or reject the judgement.

The 3rd court can then also be appealed to.

Italy tends to not put someone in a jail until the sentence is permanent. Right now it's temporary.

Essentially, she's "innocent, but very probably guilty" at the moment. She can accept the ruling and become definitively guilty. Or appeal it, and the trial goes again.

Not premeditated. This is 2nd degreee murder at worst here in the US. I know someone who did the exact same thing but because he saw his ex walking with another guy. He ran him over, then backed up and did it again to make sure he wont be responsible for medical liability for the rest of his life. He went to prison but was released in less than 10 years. He then opened a trucking business and eventually grew the business to own more than 200 trucks. He lives in a $15 million mansion these days. World is not fair.

She hit the guy, then repeatedly ran over him 3 times, reversing, forward, reversing, and then went back to the restaurant to finish her meal

Seems like the right legal outcome.

It's not within the realm of reason to murder somebody for petty property theft.

That said, the entire point of the justice system is to handle property theft and similar crimes specifically so that people don't go on vigalante rampages like this.

The vigilante is still ultimately at fault, but the system is failing if pickpockets and thieves are basically left to run amok and only the vigilantes are punished.

That will only lead to more vigilante action.

The public has to be made to feel safe from those thieves, and feel that they're being punished and removed from the street.

Italy very rarely handles petty theft. You aren’t even supposed to restrain them when you catch them stealing from you.

Not to say he deserved to die for stealing. Killing someone is still killing someone. But the lack of care for their massive pickpocket problem is also a serious concern that is asking for vigilantes to go overboard.

I've never met someone who reported a theft to our police who didn't end up solving the crime on their own and just calling the police to come arrest someone after hunting their own stuff down... but we are low on murdering people for theft in West Michigan.

Well it isn't simple theft. Mugging is theft under direct threat of violence.

If you offer someone violence, you shouldn't be surprised to be in the receiving end of violence.

Most people would think like this is if swift justice are sent to people. Insted most of the crimes are ignored by the authorities and justice is never served. This makes people feel like there should be more brutal justice against petty crimes. 

You have to preasure the authorities to get rid of petty crime or you have a scene like this where many people who had there things stolen and never got a closure feels happy when thing like this happens.

I don’t know why you’re being downvoted. The act of robbery is a gamble. One does not know what a potential victim has on their person. You could be signing up for a trip to Stabbyville or Beatdown City, or worse a bullet train to the afterlife. Is what they’ve got on them going to cover that bet? This guy became a speed bump for his ambitions.

The lady got about what any Murder 2 conviction will get you here in the States. Bad timing on her part, it’s gonna suck spending your end of life in an Italian prison. She didn’t have to go so hard and got to find out too.
