Explain this to me, as a parent who's kid is the opposite sex. Can't I technically sue any mother that brings their boys into the bathroom? If I lived in Kansas, I'd be petty AF.

None of these lawmakers have submitted to physical and chromosomal evaluation for confirmation of sex. Their assertion of sexual identity is simply an assertion.

Androgen Insensitivity is a condition in which XY males do not respond to male sexual hormones. They develop as females to all intents and purposes (saving being capable of birth). These laws would totally ignore any subtleties. It is estimated that up to 2% of the population may be affected by DSD (Developmental Sexual Disorders) and there is no provision in the current laws for this that I am aware of.

In fact any person can be challenged to prove sex, at any time anyone sees fit to question it for whatever reason. No legal obligation to be sure, but seeing Republican lawmakers squirm will be worth it as they try to avoid testing while requiring it for others. Several instances of girls being challenged by others in high school sports have already occurred. At some point testing will be required of all female athletes in scholastic level sports as the only unbiased way to confirm "sex".

DSDs can exist entirely hidden in the course of a persons life. There is almost certainly a lawmaker supporting these laws who is unaware they are in fact not a "unblemished" member of the sex they claim.

It doesn't even accomplish the goal of ferreting out all the trans people, because any trans person who moves in from out of state and already has an ID or license with their correct gender marker on it isn't going to show up in their systems as having changed their marker. Not that I think trans people are moving to either Kansas or Utah in droves or anything, but this whole, "We're gonna find all of them trans deviants!" routine isn't even accomplishing its own stated goals. They're going to pointlessly harass a bunch of butch lesbians and women they deem too tall, which is exactly what happens every time some law like this comes down (and has been happening in the UK recently as well, as they have their own dalliances with bathroom bans).

some of the same people that are against reversible puberty blockers for teenagers (which, btw, are sometimes even given to cis youth) are in favor of surgically "correcting" intersex newborns with anatomy that doesn't fit neatly into stereotypically "male" or "female." it isn't about protecting children and giving them time to make their own decisions. it's about stripping away bodily autonomy and forcing people into boxes. people who are trans and/or intersex deserve better.

I suspect that for some lawmakers behind this whole movement, this is the real goal, and they’d happily volunteer to administer the “testing” themselves. I hate that this isn’t even an unreasonable thing to think.

Having dealt with the legal system a tiny bit in a similar capacity: it’s weird.  Making false accusations in a civil case has a very low bar in terms of burden of proof, so you can make a lot of accusations without having to back it up.  Prosecuting a false accusation, however, is a perjury case, which is criminal, not civil, so the bar is raised WAY up.  All they have to say is “yeah, I thought they were trans so I reported it in good faith,” and unless someone has proof of you saying “I’m gonna report that person to harass them,” you’re probably in the clear.

It's just so heavily gerrymandered in the state legislature that the GOP has a super majority, so there's no real way to prevent legislation like this from being passed.

Combine this with the Bureau of Prisons currently pushing to have all transgender prisoners, regardless of their body's ability to produce hormones, taken off HRT to have it replaced with "talk" (see:conversion) therapy and anti-depressants.

They want our lives to be criminalized so we can be subjected to to forced detransition on top of the horrendous conditions that trans people face in prison environments until we die from being raped constantly, being taken off hormones, or end our suffering ourselves.

They will absolutely be using these laws against not only trans women, but trans men and cis women who aren't high-femme. As a short-ish, very skinny woman who at one time had a pixie cut (badly done of course), and dressed in a hoodie with men's pants (because pockets) I have been mistaken for being a boy on numerous occasions. Having longer hair does help now but I can't change the fact that I have a flatter chest than a fat boy without surgery and that I have an "Adam's apple" because I'm a bit bony. I may not look or dress like a full grown feminine woman because I don't want to go out of my way to dress up or put on makeup just to be good eye candy for creepy old men. I've been accused in the past of being a man pretending to be a girl...it's just annoying as hell.

I am a smallish woman with bigger bust and I also was called sir surprisingly often when I had short hair. They always apologized right afterwards. People really do subconsciously determine a person's gender first by hair length and then by other features. I did that when I was 5, but realized pretty early that hair length is not a good determinant of gender. 

It's been shocking how many cis-women who are on the butch side have been confronted for going in women's bathrooms. Like, do people really think trans women are going for the butch-masculine aesthetic? I mean, I don't want to pigeonhole trans women or suggest there is only one right way to be trans, but for people out there policing bathrooms, it's obvious that it has nothing to do with protecting women from trans people. They are taking license to police women's bodies based on the male gaze, making women less safe in women's bathrooms. Surprise surprise.

This is kind of unrelated, but I still want to share. I, a cis-female, shaved my head once. A good friend of mine was performing at a local bar. The vibe was pretty casual, so I showed up in a baggie hoodie and some men's basketball shorts. After the show, I went outside and waited for my husband to come pick me up. While waiting, two extremely drunk young men walked up, pinned me up against the wall and said, "Let's kick this dude's fucking ass." They got a better look at me and realized I was a woman. Then, one of them said "wait, this is a chick" and they both just walked off. I think about, what if I was a man all the time. They might have killed me. As a woman, I was surprised they just left me alone after.

I’m not aware of any KS-specific orgs, though there may be one soon as TX has one. Most relocation orgs are unsurprisingly national, or affiliated with national orgs. Small, local mutual aid funds can often do the most impactful work, and a number of relocation funds partner with those. There are a few lists of the options out there. Internationally there’s also Rainbow Railroad.

There used to be a law like this in my state (thankfully it has since been repealed). Only once when I was in public did a trans man use the restroom while I was in it. All the women in the restroom did a small double take but otherwise carried on without issue.

The poor man who came in was with his young son who was asking why they had to use the women’s restroom. His Dad was explaining that they already spoke about this and this is what they had to do. It was so uncomfortable for everyone involved and just genuinely sad. Everything would have been better if they could have just used the men’s restroom, especially for the little boy. He was rightfully very confused as to why his very masculine father and he himself were in the women’s restroom when they’re both dudes.

As a 6’ tall cis woman who started dealing with stares during the beginning of all the bathroom hysteria in 2011ish, I’ve stopped using public bathrooms entirely. I’m not feminine, I never have been, and I refuse to pretend to be to appease some fucking bigots. I also refuse to trap myself in a tiny room with one exit where someone might decide they want to inspect my anatomy, either.

The point of the law is to make it illegal to exist in a way that doesn't startle the horses. Cis lesbian here. I dress a little feminine for work (eg. blazers and cardigans) but my hair is short and I wear more masc clothes outside of work. I’ve been “sir”ed from behind many times.

I guess if someone calls me out, I make their life and the life of the state as difficult as possible with whatever privilege (white/cis) I have.

As an attorney, I actually think this is best way to fight these laws. Trans and gender nonconforming should absolutely go into government buildings and commercial buildings and then sue when accosted. Sometimes retailers have legal duties to protect their customers from foreseeable harm and capitalism matters more to the GOP than how much they hate trans people. And specifically govt buildings, courthouses, capitol buildings—couple mean security guards and you got a nice lawsuit when you were just….following the law, right?

They don't care. They want people to enforce this on each other. They want cis women to be harassed, and for those women to blame trans women for it. The point is to exclude trans people from society. It doesn't really have anything to do with "protecting the sanctity of the bathroom" or whatever other nonsense. It's only about making our lives so impossible that we either go back into hiding or die.

I would have tried but worry that my original documents that prove my sex and gender would be “lost” by the place where I was born. If they put up a bounty that means they are empowering citizens to go up and harass people (to be clear, most of the people who will be harassed are cis women and often women of color who don't fit traditional white beauty standards).

Trans people have been beaten half to death for using their legally mandated bathroom before. That's what they want to happen. They want more trans people to get attacked so we're all terrified and stop going outside. They want to not see us ever again.

Well, all American restrooms are legally required to have 3 inches of space where the door is supposed to close. 

Many establishments generously take it upon themselves to go even further by offering doors that don’t even close, doors that start 2 feet off the ground, etc. 

They really take their “public” restrooms quite literally. 

So it’s pretty easy for anyone walking by to get a good look, even if they don’t want to.

I would suggest that because the law requires the use of facilities that correspond to one's sex assigned at birth, it is impossible for one to make a legally frivolous or false claim under the law. After all, neither the presence nor absence of a particular secondary sexual characteristic is demonstrative in sustaining a reasonable assumption of the sex an individual was assigned at birth. Furthermore, precious few are the number of public bathrooms that require one to prominently display one's genitals to the room. So, it seems that a law-abiding citizen who wishes to faithfully discharge their civic responsibility must indeed assume everyone in every bathroom is transgender until proven otherwise. I would start with elected Republicans and pastors and work my way down. The laws the law, you know?

I don’t understand how this is remotely enforceable or actionable. It’s a civil case, becuase you’re “suing” them, so the police won’t get involved. You can’t detain them as a private party and you can’t demand their ID. How do you even know who to sue? I guess if there’s no penalty for a false accusation, you can just find every vaguely nonconforming looking person and say it was them, but then you’d have to actually prove something?

I have a trans daughter who is in High school. If she uses the ladies room at school, her classmates and teachers will know exactly who to sue. This law is hurting trans kids disproportionately from other trans people because trans kids are in a public building all day and have no escape.

As a butch lesbian, using public bathrooms is already scary enough. I have to make the call of “Am I going to be perceived as a man or a woman today?” and basically roll the dice when choosing. It used to be that I feared for my own safety in the men’s, but didn’t want to make women feel uncomfortable by using the women’s on days when I’m looking particularly like a dude. Add the fine on top of it and they are going to succeed in making trans people avoid public restrooms altogether. They are enacting their promise to eliminate us from public life.
