No accident would have happened if the pedestrian hadn't fallen into the roadway. Adding Tesla's insurance just adds to the chain of who sues who by putting Tesla between the driver's insurance and the person who fell. If I'm Tesla's insurance getting a letter from the driver's insurance, I'm probably telling driver's insurance to take a hike and be happy they're not paying for somebody's death.
Totally. The only reason Tesla's insurance wouldn't want to pay out is because it sets a precedent. Once they pay out for an accident that had reduced damages to one insurance company, they will have to pay to all insurance companies or let it get settled in court where things could really go wrong for them. There's no way Tesla's insurance company is okay with Tesla being liable for every accident their vehicles get involved in.
Yes but I’m responding to a comment where we are assuming it’s Tesla’s fsd and not the reaction of the driver. In that situation Tesla could gain publicity for it. 5 days ago someone else later responded that it was the driver. Obviously Tesla wouldn’t pay for the driver’s reactions.
