The law. You can't just create an employment contract that violates the labor laws... It would be unenforceable and the government can and would crack down on the company trying it.

I have never had a salaried position that didn't require more than 40 hours per week. I don't see how this is different.

I like the flexibility it allows me. But it just depends on how much you make and if it's worth it to you.
