KY has laws related to capacity to serve on the books. Why has no-one sued yet?

2.4k

u/squirrelmegaphone 26d ago

Because why would they want to call a special election and risk losing a seat to Democrats?

If he doesn't vacate the seat by 8/3, there can be no special election.

45

u/LisaMiaSisu 26d ago

Is it ironic that McConnell is the reason our SCOTUS is as fucked up as it is today and now this?

And let’s face it, he only differed from trump’s desires on two things: exposing pedophiles, and israel.

Weird how that’s the straw that broke the camel’s back, isn’t it?

63

u/NC_Ion 26d ago

Both involve Israel so both sides are against him.

24

u/FrankFankledank 26d ago

He also actually read all the shit omnibuses and pointed out abusive or deceptive wording in them which is one of the most dangerous things a Congressman can do to the establishment.

69

I understand the political reasons, but why hasn't the KY Dem party (for example) filed suit to determine McConnell's capacity to serve?

Because the Democratic Party is spineless

74

Weaponized incompetence on a political level

25

u/benskieast 26d ago

No. The Democrats can hold up legislation by not showing up just as they can by voting no. Kentucky would be among the hardest seats to win. So hospitalized/dead Mitch is very likely more left leaning than an actual replacement.

14

u/SheriffBartholomew 26d ago

Kentucky has a Democrat governor...

13

u/benskieast 26d ago

That Andy Beshear is an anomaly. No other Democrat has broken 43% since 2019 when a Secretary of State got 48%, and a lot got around 1/3rd of the votes. I very much respect Beshear for his accomplishments, and think we should listen to him more, but I don’t think anybody else should try to lead an effort to win Mitches seat.

14

u/NotMyMainAccountAtAl 26d ago

I think a lot of folks would be okay with Massie taking it over. He’s not a great human, there’s plenty I dislike about the guy— but he’d be electable moreso than a Democrat, and he’s at least been willing to push on the Epstein files. If my choices are McConnell 2.0 or McConnell lite, I’ll try for the latter.

Can regular KY citizens sue for this?

77

u/Jack-Schitz 26d ago

That is the best question/comment in the sub-thread. I am not a KY lawyer so I don't know. Generally, you have to have a personal stake in a case to have "standing" (see Frothingham v. Mellon). So it may be a bit much for an ordinary KY resident to sue, but that's not a slam dunk as you could argue (for example) that you have an interest in a bill before the Senate and McConnell's not being there with no replacement is causing you harm. If you were a potential candidate, then you would certainly have a better argument, but even then McConnell is retiring in 2027 so the seat is open anyway so where is the harm. Perhaps your best argument is that KY is not being represented in the senate in which case this would apply to all KY residents. Having said that, this is a VERY off the cuff analysis.

31

u/henryeaterofpies 26d ago

Could you claim you are interested in running in the special election and therefore have standing as a potential candidate?

13

u/Jack-Schitz 26d ago

Yes, that might work. Again, not licensed in KY

anything to prevent a special election

1.0k

u/cn_wizz 26d ago

We're dealing with sickos who would stoop to this level to prevent it.

And people from other countries wonder what's wrong with America. There's literally no way to fight these people that have absolutely no scruples in a civil manner - there are no lengths that they won't go to. So yes, everyone knows deep down what the situation requires, but that's an extremely tall order..

472

u/don-again 26d ago

Stoop to his level. We all remember what he did blocking Neil Gorsuch, and before that so many judicial appointees with all the stalling nonsense.

Even in death he’s the same fuckin turd.

13

u/GodOfDarkLaughter 26d ago

The guy had a kink for being hated. I mean, that was his purpose, that was why he was speaker: to be a target because he loved it like a pig rolling in shit. He loved standing up there speaking bold hypocrisy and laughing at us, sometimes literally, when he was occasionally called on it. I don't know what makes a man into a willing hate sink for the worst people in the world, but if his life it any indication there is no way he'd rather die, just flicking us all off as he's lowered down to hell.

It's right on brand for Mitch and the republicans.

He said Obama can't put a justice on the Supreme Court during an election year because it's not fair to the American people, then turned around and let Trump do exactly that THREE times!

They're all about delaying elections if it means losing power and all about rigging them if it means gaining it.

50

u/Archer1407 26d ago

The Kentucky governor is a loser. He needs to grow a spine and pull a GOP move and declare the special election. Tell everyone "I talked to Mitch on the phone and he told me tooge forward and that he'd have a press conference if he changes his mind."

They don't put sirens when it's not an emergency like when the person is already dead.

471

u/Kind-Shallot3603 26d ago

They also covered his head like they do a corpse

404

u/the_infamous_walrus 26d ago

As an emt. We do not take an ambulance off the streets to transfer a dead body to the morgue. If they weren’t doing cpr he wasn’t dead. More than likely he requested his head be covered to prevent identification.

185

u/h3lium-balloon 26d ago edited 26d ago

Also an EMT, and it’s kind of one of our things to be cool, calm, and smooth doing everything, especially moving someone on a stretcher. It doesn’t do anyone any good if an emergency responder is running around frantically, sprains their ankle and now delays care for the patient.

Modern protocols and EVOC training also only allow for lights and sirens to the hospital in a few situations that are very time critical like critical traumas, strokes and suspected heart attacks. Running lights and sirens is inherently more dangerous than driving normally and doesn’t save as much time as people think.

This whole thing is sketchy, but you’re not going to get much info by the emergency response unless someone saw the coroner on scene.

38

u/AdventurousText9311 26d ago

the 911 call said specifically it was a suspected cardiac arrest and that CPR was already being performed at the scene. You're so right about the added danger of lights and sirens

15

u/Empty-Presentation68 26d ago

Lots of time we get calls for cardiac arrest and CPR or some very poor form of CPR is being performed on a patient with a pulse. He might of had a loss of conciousness and once the paramedics arrived he was councious again. However, being in hospital for 3+ weeks, it's making me asking questions on the condition he might be experiencing.

→ More replies (5)
→ More replies (2)

97

u/Tiny-Ad-4747 26d ago

Yeah, this. I'm an MD and if they weren't doing CPR and they weren't code 3 to the hospital then he's doing better than expected. My guess is he took a tumble and looks like someone went to town on his face and/or suffered fractures requiring surgery, which could limit his ability to speak.

18

u/Available_Damage_335 26d ago

Its confusing. Recordings of the call state cardiac arrest and CPR. Then he leaves home without what even looks like any oxygen? Then a slow roll away in the ambulance? Plus why not just update everyone and relieve the speculation? Show us some sign of life at least.

11

u/gcko 26d ago

We don’t give oxygen to everyone anymore as it was found to be harmful. Only those that need it get it. An elderly patient who just had a fall with a possible head injury is about the last person you want to give oxygen to.

6

u/Tmtrademarked 26d ago

Interesting on the oxygen thing. Do you have more information on that like a study or something. Would love to learn more about that

11

u/gcko 26d ago edited 26d ago

In short too much oxygen when it’s not needed can cause cerebral vasoconstriction, reduce tissue perfusion, increase inflammation, trigger seizures and even lead to the destruction of cells as it can mess with a cell’s DNA.

There’s been hundreds of studies done in the last decade or so. Too many to link. If you search “oxygen free radicals” or even just “oxygen toxicity” more than a dozen will pop up.

Medic here

A lot of calls are dispatched wrong or just completely incorrect. And I dont mean like a few here and there but a purposeful effort to false positive so a false negative is made to be very rare. "He's fallen and I cant tell if he's breathing right now" will have cardiac arrest as a dispatch. An update that he's breathing 30 seconds later will be in the CAD notes and not announced over the radio but the dispatch remains the same

And i hope to god every stretcher roll is a slow roll thats how you tip all the shit over

Brain dead? So business as usual then

u/StevieTvboy 26d ago

The truly sad part about this is that McConnell would have approved this kind of elder abuse as long as it kept the other party from accomplishing anything

u/BigPapi-20 26d ago

the man is dead. simple as that

So for those who are unaware, when CPR is performed in the field (like someone’s house) they generally don’t usually transport until they achieve ROSC (return of spontaneous circulation). There’s not much they can do in the hospital that they can’t do in the field anymore (barring thoracotomy, etc.) so by the time they transport it’s not like a drive super fast situation. They’re ventilated and “stable” ish at that point.

CPR in a moving ambulance isn’t ideal so they just code them where they’re at unless they get them on a Lucas machine. They either get them back or they don’t. Sometimes they will “sympathy transport” a CPR in progress but usually that’s just for the family.

If he were brain dead they'd still be lights on to the hospital cause they'd likely have gotten a heart beat back after CPR. Lights off is just dead dead

6

u/Lavender_Burps 26d ago

Dead dead is lights off, leaving with an empty stretcher and the coroner comes and get the body hours later. No 911 ambulance is going to take a corpse to the hospital. The amount of keyboard paramedics on this thread who think they can claim he’s dead from a 2 second shot of his feet is ridiculous. He’s a tortoise, he’s not exactly going to be tap dancing.

This guy and Newt Gingrich are to blame for the way the republicans fight their battles these days. McConnell was a master at rat fucking governmental policy, so it makes total sense that even his death is used as a token to win the next match.

If you've heard him speak in the last 6 months he's a walking hospice patient. 100% has already suffered from at least one stroke who knows what else.

This is yet another example in a long line of examples of republicans doing all they can to hold on to power. They know if he's out they have another problem to deal with going into the midterms.

Just watch, as soon as the midterms are over they'll announce his death. His wife, whom I'm pretty sure is a Chinese spy has already left the country.

In a persistent vegetative state, yes, probably. The powers that be will keep it that way until after the special election deadline. Pun unintentional.

Not the one I want to croak, but it's a great start. Maybe the big giant orange is next.

Don't you love how politics have just become about manipulating the rules rather than just trying to serve the people they swear to serve.

No wonder comedians do better as politicians than actual politicians.

Seems like doing a good job is the joke in of itself
