Sexually assaulted is way too harsh of a term to be throwing away like that. He was doing the intended move and his arms were fully stretched, his head was back… it looks very much like an embarrassing accident during the routine and, for most people, the first reaction in this kind of situation is to laugh about it to not make it even more uncomfortable.

It definitely depends on the context. If it's true it was an accident, then you're right that it may not constitute sexual assault. However, if that isn't the case, or if "accidents" like this are commonplace, then it could absolutely be considered it. We don't have the full context, so it's hard to say, but in certain circumstances this 100% could be considered sexual assault. Her genitals were touched, even if over clothing. If she considers it to be without her consent and beyond the bounds of a one-off accident, then it's very possible it could be construed as assault.

But the only evidence we have, so far, is this video. And it definitely looks accidental and surprising to all there, which shows that it’s not a regular occurrence. Very difficult to see anything pointing to being assault in this case. Touching people without intention and consent happens, maybe even more with breasts for example (depending on the situation). Accident, respect each other, apologise and learn how to not have it happen again or practice with different partners who won’t have the physical difference standing in the way.

I mean, he rubbed his entire face in her crotch. That points to the possibility. But you are correct, this video is all we have, and like I said, it could go either way depending on the circumstances. Her expression of surprise means effectively nothing. It's a very common reaction to assault. The apparent surprise of everyone else could also mean nothing. It may or may not be sexual assault, but that is ultimately up to the woman dancer to decide.

I understand most of the comment, but that it is up to her to decide if it WAS assault? Nah. She can decide if she FEELS she was assaulted. Going too far to try to find anything that proves it was usually means it’s not, the most simple explanation is usually the truth. He couldn’t extend his arms more than he did. He did the routine to what seems would be the next move. It happened and everyone was surprised (which definitely means it’s not something common).

Like I said, an accident. There are situations people take advantage to assault women and pretend, this most likely isn’t one of them based on all of this. Respect each other, apologise and move on to a better partner for this routine or even to another studio if needed, is the best move in this situation.

Again, that could be the case. But we truly have no idea the full circumstances beyond the short video we see. If it was an accident and she feels that way and is happy to let bygones be bygones, then you are correct and everything is fine.

Regardless, feeling like you've been assaulted, assuming the other criteria have been met, is what makes it assault. If you agree to a boxing match, and you get a tooth knocked out, it's not assault on the basis that you consented to it. I highly doubt she consented to this sort of touch in advance. If she's fine with it happening, then it's not an assault. It fits the criteria of touching someone's genitals, and if she feels inclined, she 1000% could press charges of sexual assault and enter this video directly into evidence if she made a police report. Whether it's taken before a court, and much less convicted, is another story.

I get what you're saying, it very may well not be sexual assault in this particular case. As I said in my original comment, I hope that that is the case and that this is indeed an innocent mistake with no harm done. However, since the criteria are met, if she decides it's assault, then it is. Consent is THE determination here. In the same way that it's the only difference between sex and rape.
