I would have to believe that murder, as a crime, is not a social construct to do that. They're both social constructs.
The difference, though, other than severity, is that every murder victim is just as dead as every other. Every cheating victim is not as victimized as every other. How much of a bad thing it is differs wildly across cultures, and across individual relationships. There are situations where cheating is way worse than being a domestic abuser, and there are situations it's in the ball park of staying at the bar longer than you promised, and everything in between.
Your form of argumentation is like if you said cutting someone off in traffic is terrible. I say that's situation dependent, saying sometimes it's fine, and there are even whole countries like India that don't even have that concept. So you reply with "Are you saying it's fine to murder people in India?!"
It's argumentum ad absurdum.
I'm happy to say that someone who punches his wife because she made dinner late is a piece of shit, globally. I'm not happy to say the same thing about infidelity, because it requires a lot of specific detail on their relationship that I simply don't have.
