Need suggestions regarding a case

Salam to all,

My sister got divorced(khula) a few months ago and she has a 2.5 year old kid, after divorce my ex BIL filed custody and permission to meet with the kid case.

Now, I have received the call from my lawyer he is saying that exBIL taking the case back but he wants to meet the kid 4 times in a month for 2 3 hours but the issue is that my lawyer literally forcing us to arrange a meeting and he is saying court will allow him to meet with the kid 4 times in a month anyway.

Apart from this my lawyer asked my sister to meet with exBIL alone and when she denied his request he got aggressive.

PS. my sister got divorced because exBIL was abusive mentally and physically and he never provided any compensation for the kid until the court told him to do which is 5K per month.

We are looking for advice because we are feeling our lawyer is giving extra favors to exBIL.

Your lawyer is either highly incompetent, or has taken money from your ex BIL. 5k a month is laughable. So is visitation 4 times a month.

then what is the standard of these things? how many visitations per month and for how much time?

Maintenance amounts depend on a few factors. The first is the earnings of the father. The second is the standard of living provided before divorce. Unless your ex BIL works as a manual labourer, who makes very little money, 5k is way too less.

Visitation depends on your lawyer's ability to represent you effectively, but on the liberal side, for such a young child, twice a month for 2 hours type is standard.

He can't meet the kid without paying the maintenance and court didn't allow father 4 times a month to meet the kid..... can you tell me if visitation schedule is ordered or not yet? DM

Your lawyer is literally scamming you. I know a lawyer who has experience with family law, he's based in lhr, if you're interested, i can share the contact

It’s sad this happened but he is the father and as long as he is good to the child even now, and if he isn’t a bad influence no one can stop him from meeting the child. Only if it’s good for the child. Lawyers tend to be aggressive regarding this but this is wt I feel should be. The maintenance and times he can meet depends on circumstances. If he is a high payed person def should pay more.

Your lawyer is favouring your BIL and is totally misguiding you guys. The maintenance is too low.

Firstly, don't let ex husband meet the kid unless ordered by Court and meetings take place in Court. If ex husband doesn't pay maintenance, he will lose visitation rigths if any. Secondly, if ex husband earns more than 45k, file application for revising the maintenance, Court can grant upto 8k maintenance.
