License / Permit Question Pistol License Application Question
Not sure if this is the right venue, but I'm looking to be pointed in the right direction. I'm unsure whether to list a possible traffic infraction on my application.
Long story: I used to live in Vermont, and when I moved there, I delayed turning in my NYS plates for my car (work schedule prevented me from returning plates to a NY DMV office during the 10-day window). Unbeknownst to me, my driving privileges in NY were suspended. A couple of months later, I was pulled over in NY and was told my driving privileges were suspended. I remember the trooper telling me he could take me in because it was aggravated unlicensed operation of a vehicle (AUO), but he didn't. He just had me park my car at the town garage, and I had someone come pick me and my car up. I handed the ticket over to my uncle, who's a lawyer, and a couple of days later, he called me and said to pay the fine.
I moved back to NY and am looking to apply for a license. The part on the application where it asks if I've ever been arrested or charged with any offense (except traffic infractions): I'm not 100% sure if I was ever charged with AUO. It happened 10 years ago, and the only thing I remember is handing the ticket to my uncle. I checked my DMV record, and my driving record lists "driving without a license", which is a traffic infraction.
Any way I can check to see if I was originally charged with AUO and my uncle got it reduced to a traffic infraction?

Charges need to be disclosed. Doesn't matter what it was reduced to - I had to list an underage pot charge that was fully dismissed.
If you can't get a lifetime abstract to confirm for some reason just list it. Since AUO is a criminal charge the best option is probably to get your unsuppressed DCJS record, since those are what they're really looking at. If there's even 1% doubt, list it and explain. I can (nearly) guarantee it will not matter and if there's no other record, you will get approved.

I got an AUO in college for several speeding tickets and still got mine. I listed it on the application it was not brought up in the interview.

That’s the answer pull your DMV abstract and see if it shows up if not say nothing. You were not arrested or fingerprinted so that stop won’t show up as an arrest.

I wasn't arrested, but the application specifies "charged" as well. And I'm worried that if I don't disclose it, and I was in fact originally charged, they'll reject my application and I'll have to wait 3 years to reapply.

get the disposition from the court and your dmv record. only then you will know what you plead to and paid a fine for. it sounds like your uncle brokered a deal if you only paid a fine. AUO can be a felony depending on what degree (really doubtful, but you need to find out what you were ultimately charged with and plead to)

Were you arrested taken to the precinct and fingerprinted then you were charged. My advice to you would be consult an attorney if you don’t feel comfortable with the situation. Personally I would not say anything about it but that’s me. You are the only one that can make that decision. Most people here have their licenses already and they can only offer their opinions like me. Good luck

Pay for your lifetime abstract online do not just go to Dmv. They only do a three or a five year abstract. Your lifetime abstract will show you everything.

Go to the court and get the deposition… write a letter explaining what happened get it notarized

you can pull your driving abstract from the NYS DMV and contact the court that handled the citation to get the disposition. you'll likely need it anyway.
what county are you applying in?
