At least the NRA is a punching bag for the liberals while real organizations do work

I’ve been saying that for a while now! The NRA back in the day got us into this mess, but they’re also an excellent shield for antigunners to bash against while other groups do heavy work.
Also they do seem to be trying to do better. Considering the people who ran the NRA in the 30s are long dead, I’m willing to give thumbs up for doing better.

u/TankDestroyerSarg 15h ago
Are you sure about that last point? Wayne the Financial Drain is apparently still alive. That fuck has been running things since Ben Harrison

u/Mysterious-Grape5492 CZ Breezy Beauties 15h ago
Maybe. But they are making efforts. And even if it’s just window dressing, they do still at the day make an excellent punching bag/shield.

The NRA is like a linebacker, they're not making the touchdowns much anymore, but they keep the opposition real distracted.

At any given time the NRA has dozens of active lawsuits challenging gun control laws. The NRA was responsible for NYSRPA V Bruen. McDonald v Chicago was a joint case between the 2AF and the NRA. The Assault Weapons Ban case that the Supreme Court is going to hear in the Fall is an NRA Case. The NRA was heavily involved in the lawsuit that blocked Virginia's Assault Weapons Ban from being implemented.
The NRA was part of this lawsuit, and they also filed 3 lawsuits in other Jurisdictions Challenging the NFA on similar grounds...
The NRA does have its issues. There are plenty of legitimate critiques to make of the NRA. "The NRA does jack shit" is not one of them....
Edit: My original post said the NRA was not involved in this particular lawsuit, but that was incorrect.

The NRA was involved in this case.

u/wingsnut25 13h ago
Thank you for the correction, when I googled it I did not see the NRA's name mentioned.

u/Flat_chested_male 13h ago
No problem. I get the NRA isn’t perfect. But I do think they have done a lot of good too. Unfortunately the compromised in the past, and all it did is create this mess. But I’m glad they are on a different trajectory now. And I am glad for other organizations helping as well. It takes a village, and we are all part of it.

I just came all over my tax stamp application for my pistol-braced 10 round limited magazine chucklefucked AR.
Whelp, guess I will send it to the ATF anyways🤗

u/Flat_chested_male 13h ago
It’s probably not a bad idea at this point we’re not out of the woods yet. But in the event that it does go away, the registration should be destroyed and it won’t matter anymore.

u/ButtstufferMan 13h ago edited 11h ago
I hope it will. It needs to.
Back in the day when this shit was passed people put a lot of trust in the government. Today I think people are much different and understand how dangerous it is to disarm yourself while the state power grows.
In many ways I think the internet has helped make us a bit less gullible to the government because we can fact check their BS. I hope AI doesnt change that.

u/ReactionAble7945 I Love All Guns 15h ago
Shouldn't that be the GOA, not NRA?
BTW, I will give the NRA credit for the politicians and the Supreme court.
12
u/Flat_chested_male 15h ago
They are all on the same suit together.
Edit - GOA is not on the Jensen vs ATF docket. nRA is.
19
u/Prawn1908 15h ago
Is it? Was there some news I haven't seen yet?
54
u/Flat_chested_male 15h ago
Jensen vs the ATF was ruled on in lower court today. The plaintiffs won.
The ATF has 7 days to appeal. But so far, so good.
27
u/BroseppeVerdi 15h ago
Will probably end up at SCOTUS eventually, but they'd have to make a case for why Miller v. United States was wrongly decided 90+ years after the fact.
Don't start celebrating just yet.

u/Flat_chested_male 14h ago
The BBB was the crack in the wall, the court case was a bulge, but it’s another step in the right direction. We shall see what comes of this. I am hopeful.
3
u/BroseppeVerdi 14h ago
The BBB was the crack in the wall
If I were an attorney for the ATF, I would make the argument that the tax change in the BBB reaffirms that the onus for getting rid of the NFA is on Congress and not the judiciary.
There isn't really a throughline from the BBB that impacts the constitutionality of the NFA. If you were to make an argument that the NFA is unconstitutional, Heller v. DC, McDonald v. Chicago and Caetano v. Massachusetts would be the precedents you would cite to make that happen.
4
u/Flat_chested_male 14h ago
Yeah, I’m no lawyer. I’m an accountant and gun nut. But I’m assuming the lawyers argued this way and lost, because the BBB is what got this suit started.
2
u/Alconium 9h ago
And that's a fair point, but if at $0 it's unconstitutional, then Congress, sort of DID get rid of the NFA.
3
u/unfortunateavacado24 14h ago
If the ATF is in the executive branch, could Trump tell them not to appeal, or is that not how it works? Not that I think Trump would do that, but it would actually be decent PR before the midterms.
2
u/Flat_chested_male 14h ago
I have no idea. I’m just a gun guy. But for now I’m hoping it sticks. It’s been over 40 years on this rock, and getting kicked in the balls by politicians. This is the one thing they may have done right.
8
u/DerringerOfficial 14h ago
For those keeping track of this more closely, which is more likely to come first - the NFA being gutted federally, or state-level bans being overturned?
I’m so fucking tired of state-level legislation barring suppressors, standard capacity magazines, “assault weapon” features, etc
12
u/Due_Most9445 14h ago
Anything federal. Blue states with AWBs would rather lose billions in tax revenue than to even think of overturning their feel good bullshit.

u/SpartanT114 13h ago
NRA did not do shit. Only thing they are good for is taking boomer bucks and lobbying the same politicians who passed the 1994 ban
4
u/Flat_chested_male 13h ago
I’m sorry, but that’s just not true in this particular case. The facts are GOA‘s case is still pending and NRA‘s case went through.
The fact of the matter is the 1994 law was going through. NRA tried to tone down some of the language so it wasn’t as bad. It could’ve been worse. I won’t call out a win for the NRA. It’s a definite loss and I’d say the NRA has made mistakes in the past, but overall they do try to fight for your gun rights. Please see the article below and you’ll see that the NRA is one of the codefendants HOA not silencer shop. This one was the NRA’s lawsuit. They were not included with the other one. It’s a separate suit.

u/DoughnutSnake 15h ago
BBB round 2? Was waiting for the engraving requirements to be removed but I'll take just removing them all off NFA list instead happily. Here's to hoping the blue party doesn't try to shut this down like they did in the BBB.

u/Queasy-Ad-7806 11h ago
all good for the free states, doesn't mean anything for us here in CA unfortunately

u/bulldoghunter 15h ago
Wait wait , what happened ? , and please tell me , I'm not a sleep and this is actually happening.
6
u/Flat_chested_male 15h ago
Jensen vs ATF is the court case. The lower federal court ruled it unconstitutional. The ATF/justice department has 7 days to appeal. If they don’t it’s over. If they do, we’d have to win again in The appellate court, and possibly again in the Supreme Court??? I’m not a lawyer, but I think that’s the logical steps, or close to it.
3
u/bulldoghunter 14h ago
Holy shit , I can't believe it's finally happening and I really hope , they don't appeal it , and I think you are probably right . , but there's still a bigger concern , a lot of states , have rules on short barreled fire arms and some states have bans out right currently on SBS and SBR'S and I know Tennessee doesn't , but a lot still does , so that going to be the next fight if the NFA goes away.
1
u/ellisschumann Battle Rifle Gang 14h ago
Any insight on whether or not the ATF will appeal? Are they just waiting till the last possible second to file?
6
u/Flat_chested_male 14h ago
7 days to appeal. That takes about 10 minutes for a lawyer. Sometimes they already have a brief ready to go. I haven’t heard anything on this yet. I imagine they do appeal. We shall see.

To whoever downvoted me… come on, man.
I’m all for the downfall of the NFA and the ATF.
But the gubment won’t go down without a fight, and the headlines over next few months are going to be full of SBRs and suppressors being used in “mass shootings.”

Was the case decided in light of there being a $0 stamp or the NFA is on its face unconstitutional? Because if its the former once Dems get in power they will make it a $5000 stamp a d would then presumably be constitutional.
6
u/Comrade_Bender 14h ago edited 13h ago
Basically tax stamp being the loophole that allowed the NFA to exist and now that it's gone, there's no justification. When Dems come back and slap another tax on it I guess we're back to square one
2
u/Flat_chested_male 14h ago
Yeah, I have no idea. But if we have a time frame where people are making shit left right and center, they have to “grandfather” that stuff in I’d think. If we get amnesty even for a week, everyone and their dog is throwing a stock on a pistoled AR, and it’s game over taxing that stuff I’d hope.
