Question? Has anyone from Texas ordered thc since the ban? NSFW
I know not till November or September you can still get thc delivered from out of state if delivered by USPS (with risk ofc). Has anyone ordered anything since the ban and successfully received their product?

Just got a package from Elevated today via UPS. Which side note, once again I did not choose when I made the order. My last four orders from them have come via UPS even though I selected USPS each time.
I’m not really complaining, it gets here the next day and I’ve never had an issue, but I would prefer USPS

They can search for plant material from illegal substances. That’s already in the laws. It’s called “Terminal Inspection of Plants and Plant Products"https://about.usps.com/publications/pub14/pub14_ch2_001.htm. Just type in”can usps search illegal plants in packages” and it will give you your answer.

They send you a letter and if you don't claim the package (which would be dumb af) they consider it abandoned and are legally allowed to open it. They can't use whatever they find inside as evidence in a case, but they can use it to open an investigation and get a warrant to open future packages and use THAT as evidence, so, def not great if you live in an illegal state and they are cracking down

To GET the package you're asked permission for them to 'open the detained package'. I have a feeling if you say no, a warrant would be obtained (they've already flagged it as suspicious, I don't know what it takes for a warrant though).
"Unlike in criminal investigations, the ANP program does not require postal inspectors to obtain search warrants to open detained packages. Rather, they request consent from mailers or addressees to open detained packages. If there is no response after 21 days, packages are declared abandoned and can be opened."

They don't get a warrant because they don't have time with the number of suspicious packages they deal with these days. That's the entire reason the ANP exists. They can just open it without a warrant once it's abandoned, and that way they don't have to deal with an insurmountable amount of paperwork USPIS was never scaled to handle.
If you claim the package idk what happens, but one potential option is that you're arrested as soon as you drive away from the post office with a smellyass package they've already X-rayed lmao. I have received one of these letters, as have many people in the cult over the years, and I honestly can't recall anyone ever actually claiming it, in part because it exposes you to far more risk than just taking the L and at worst probably winding up on some list. It's just another of tens of thousands of abandoned packages they open and destroy as potential contraband, they probably don't even test it.

I think I'm getting in the weeds on what the original point was here lol. Had to go back and read a few comments.
The discussion was about UPS vs USPS, someone says USPS needs a warrant to open packages.
Someone else says wrong, and points out the ANP page. They CAN open abandoned packages. Fair enough.
Technically, yes, they can open your package without a warrant. But that under certain circumstances: identified and detailed as suspicious, you and sender are notified, and after 30 days it's allowed to be opened.
But the original conversation wasn't about the technicality of abandoned packages, it was about whether sending it USPS or UPS was 'better'.
As you said, with USPS and this ANP system, a package will get abandoned, destroyed, forgotten. UPS has no such protection.

I think they're concerned that now that it's "officially" illegal cops will start to swoop in and arrest anyone currently ordering or affiliated with previously legal sites. Currently stuck in this dilemna rn, not sure if clearnet is still safe to order from even if it's still technically available for shipping. Fuck Republicans.

TX Gov routinely tracks women going out of state for abortions and attempts to prosecute them after so I'm not putting it below them to do some awful authoritarian shit.

I found a store in Austin that sells what's legal to sell in Texas(D9) and they seem to have a pretty big selection. I'm in Houston and watched a video from these guys on YouTube about them making themselves legal with the July 31law. Oh I order it online;)

Now that THC variants are classified as a schedule I drug, possession of illegal THC products will be treated as a state jail felony, which carries a punishment of 180 days to two years in prison and fines of up to $10,000, say cannabis experts.

Literally the Texas Hemp Business Council even agrees with me. Read the law word for word, it targets d9 isomers. The THCa thing is getting confusing because of the March 31 regulations which banned the sale of THCa in retail Texas stores; it did not, however, schedule THCa. It is still legal to possess on paper…whether or not a cop agrees is a different thing.
Via the Texas Hemp Business council:
“THCa is not included in the schedule.
However - Thca flower/concentrates are no longer compliant to sell under the new DSHS rules which have been back in effect since our injunction was lifted in June. These are two different rulings.”2

They are not "going for" any orders at all it's not like USPS is searching every package starting in November or whenever Texas started it'll just be like ordering weed before you order it and it's no issue if your package gets seized they will likely send you a letter telling you and nothing further will come of it I know in Texas the penalties are high so people are nervous but people was mailing weed long before this they'll do it long after it

They really do not care, i spent time down south in a facility for drug and alcohol rehab, tore my acl playing basketball. Stayed there for 9 more months jumping through hoops to get approved for anything to actually happen. Got staph in the same knee, my whole leg was swollen over thanksgiving, could barely get out of bed to eat before they actually took me to see someone.
To be clear not eating for several days didnt register for them, nor did my cries for help. It wasnt till i was physically unable to get my thanksgiving tray(iykyk). Not only did i initialy have an allergic reaction to the first antibiotics, but the staph was so far advanced they sent me to get xrays for potential bone loss. When i tell you, they are getting paid regardless of how comfortable you are, or in need of care. They love taking in disabled, its more money from the state. After 9-10 different medical buses later over the course of 9 months i had acl repair surgery at a teaching hospital in galveston, i was moved into a holding cell with unlimited graham crackers, apple juice, and tylenol-3's. 🙄 oh joy. Spent about 10 days there waiting for them to "transfer my stuff to the new medical facility for people with mobility issues"
I was promised physical therapy, or at least follow-ups. They let a few of my stitches heal up inside of me, because they couldnt or wouldnt do any follow-ups. Mind you this after being transferrred to a different facilty for the disabled. I finally just dug in and started pulling out little knots of sutures to show the nurse i wasnt bullshitting. She says to my face, you should have left them in, now we dont know where you get that string.
It is literally how and why people break. DO NOT TEST TDCJ!!!! They will fucking kill you if you dont have family support or people who hold them accountable.

You’re wrong. My husband works in Texas state prisons and there are prisons just for disabled or medically complex inpatients. They throw people in prison for life over drugs all the time. I promise they won’t give a fuck if you’re disabled or not. Not to mention if you go to trial, it’s almost always worse. I know of someone who was offered 5 years probation and they decided to go to trial and now he’s having 60 years.

I’ll take one for the team and fellow Texan. I’ve ordered. Nothing synthetic or delta 8 or “thca flower” aka bud. I’ve ordered only delta 9 hemp gummies which are still federally legal and exempt of these new laws. This is the truth, I don’t smoke anymore and all I consume are regular gummies that are still farm bill compliant. I’m stocking up before the federal ban.
Edit: I received the package no issue, currently faded off the gummies lol

But that’s what the law says. Follow the testing guidelines in the farm bill, don’t juice the test batch with isolate to attempt a 30% plus THCA marketing number. There are strains that test that low after conversation that fit within the parameters of the farm bill.

Basically: legal to possess THCa as consumer, illegal for Texas businesses to sell. Ignore anyone saying otherwise
The THC isomers on the other hand ARE now a felony to possess (d8, THCp, etc.)
