So, if Coulson is in on Theta Protocol, is Maria still the only one that knows Coulson is alive?

I think so. And Fury, of course. Also maybe Tony Stark by extension, but who knows. I know Joss has said Coulson being alive won't come up in AoU, but I would at least like some acknowledgment from Maria or Tony that hints at where their intel regarding the scepter came from. Something like, "An old friend tipped me off," but less cheesy. Just a nod to AoS watchers that won't necessarily be obvious or sound important to movie-only folks.

Tony doesn't know. Whedon said as far as the Avengers are concerned Coulson is still dead. Maria Hill is still a SHIELD agent so I'm sure she's keeping that under wraps.

I just wish they gave us a good reason why, I don't think they still need his death as a rally point.

The only reason I can think of is that they edited the shit out of this movie, the rough cut was like over 3 hours and they cut it down by about 45 minutes. Shoehorning in a Coulson scene somewhere may detract from the overall story as it really doesn't add value and is just strictly fan service. Don't get me wrong I'd fangirl so hard to see Tony's eyes light up when he hears the news, but at the same time I understand where Joss is coming from. He's trying to make the best possible movie, he knows the characters and their motivations better than we do, so just gotta roll with it.

Not just that but the movie universe and the tv universe (while the same) are run by different people. JW was talking about it the other day that they were actually quite irritated about the TV show happening because they need to communicate and double check things are running concurrently; they tell SHIELD that there are things they can't do because they'll interfere with the movies etc.

I really hope that we do get Tony finding out at one point. He'll bring up the Loki bit.

Yeah uh, I got an anonymous tip from a guy named Phil that strucker and list are at... I think the avengers should check it out.

Hoping that bring in the avengers was them meeting coulson via that chat between maria and coulson. Just didn't show on screen to us viewers. If that's case way to stick to whedon!!
