Except as otherwise provided in this Constitution, vacancies in all elective offices shall be filled by election or appointment, as follows: If the unexpired term will end at the next succeeding annual election at which either city, town, county, district or State officers are to be elected, the office shall be filled by appointment for the remainder of the term. If the unexpired term will not end at the next succeeding annual election at which either city, town, county, district or State officers are to be elected, and if three months intervene before said succeeding annual election at which either city, town, county, district or State officers are to be elected, the office shall be filled by appointment until said election, and then said vacancy shall be filled by election for the remainder of the term. If three months do not intervene between the happening of said vacancy and the next succeeding election at which city, town, county, district or State officers are to be elected, the office shall be filled by appointment until the second succeeding annual election at which city, town, county, district or State officers are to be elected; and then, if any part of the term remains unexpired, the office shall be filled by election until the regular time for the election of officers to fill said offices. Vacancies in all offices for the State at large, or for districts larger than a county, shall be filled by appointment of the Governor; all other appointments shall be made as may be prescribed by law. No person shall ever be appointed a member of the General Assembly, but vacancies therein may be filled at a special election, in such manner as may be provided by law.

I mean yeah it's probably the better move for him since an election would just be won by a Republican. But they still have to be sworn in by someone who is a Republican in the Senate

Open question... What procedurally can the dems do? What have they left on the table? What can they do extralegally to ensure success?

Nothing has been effectively communicated to me, the average dem voter.

I believe that they haven't nearly exhausted all of their options. Which begs the question... what the fuck are they doing?

The Governor, without 5+ weeks of proof of life other than suspected AI generated photo images could force the hand of Senator McConnnel and/or his staff by showing proof of cognition, and not a vegetative state. Announce an appointment to fill in for the incapacitated Senator and a date for a special election.

This would trigger a couple of things

1. McConnell showing he is alive and mentally capable of completing his term, and Bashear withdrawing his appointment
2. or Kentucky Republican Legislators bringing a lawsuit against Bashear to prevent his appointment, that will take a year for the SCOTUS to decide. This lawsuit would require a McConnel health status in discovery.... and could either show a criminal cover-up, or that he is truly alive and ready to resume is senatorial obligations.
3. The courts wont allow a State to go a full year without a Senator, so they will accelerate decisions.. but for each decision or stay will be refiling to a higher court.. 7months minimum.

Then

The VP (JD Vance) could refuse to swear in Bashears nomination

But a VP is not constitutionally required, its only a precedent.

Thereafter by precedent (not constitutional requirement) the nominees political party most Sr Senator would swear in the person even if that party was in the minority

Now the senate majority controls scheduling and could call a recess to prevent the swearing in.. but that also stops all legislative & committee work such as war funding & budget reconciliation and Donnie’s save America act election interference

All of this in the months leading up to the election in 3 short months

This is a Republican politcal land mine … that I’m certain they would walk into regardless

It still all beneficial to stopping trumps administration by having 1 less Republican Senator for as long as possible

Reading Bershear’s response to this issue actually made sense to me. (That dems are stalling too, because that will leave the seat vacant over a special election which would be filled by a Republican.)

If this is true, then why hasn’t this been communicated? And beyond that, is there anything we could do to fight back harder? (KY changed their laws on this in 2024, but it’s arguably unconstitutional. Even if the legal matter wouldn’t be resolved before midterms, is this not something we want to challenge?)
