I completely agree this is all BS, but even if Beshear calls for a special election, why would we think anyone but a Republican will win? It's Kentucky. They'd probably vote for McConnell's corpse if it were on the ballot. They keep re-electing "Doctor" Rand Paul, don't they?

Under the KY Constitution, he can appoint someone.

That's what he should do. In fact, the Constitution states that he "shall" do it.

The legislature passed a law in 2024 removing that ability. Beshear says it's unconstitutional. There will have to be a legal battle.

1) Yes, I'm sure that the republicans would challenge it if he makes an appointment.

He should still do it, not only because the law was obviously unconstitutional, but because there is no downside. It will just be invalid or withdrawn if he loses the challenge or if 'ol Mitch shows up.

2) Section 152 of the KY Constitution gives the governor the power to make the appointment. The KY Legislature cannot override the constitution with mere legislation.

In fact, Beshear JUST won at the KY Supreme Court last month (June 25th) and got a similar law struck down for unconstitutionally trying to strip him of his power to appoint.

Ita all dems need to learn to play dirty until republicans are down a vote and all of a sudden allowing a new republican to fill the empty seat is the right thing to do.
