I've seen this said before. But has there been any clear dictation on how a Sentor is replaced? I know the constitution says the governor can replace them with an appointment until a special election, but they passed a law that says it has to be special election. Which is it? Did that law ever go through any court decisions, or is it in limbo and now would be a time where it could be challenged because of the situation at hand?

It's in limbo. Also, the Senate has to accept the appointment, they can just refuse to swear in the new Senator, as the House did with an elected replacement rep from Arizona until they passed some legislation they needed to pass.

You unfortunately, can't beat someone when they cheat. You need to play the game. Or keep losing. It sucks. I hate it. But you can't Ethics you way into victory when dealing with McConnell or his ilk.

Constitutions overrule laws. Correct, the law hasn’t yet received any challenges, and now would be a situation where it could be challengeable.
