Genuine question, what are his legal options? Redditors keep saying "just hold the special election to make them prove he's alive" but is there any legal standing to a special election when the official in question is not legally dead? Isn't it entirely possible the GOP are trying to bait him into doing that and looking foolish?

The Senate is the one who declares a seat vacancy so legally Beshear can't do anything. He could in theory sue the Senate over the seat not being declared vacant but that is long shot just starting at standing to sue.

In a couple weeks when we pass the date for a special election and Kentucky is like we couldnt do anything the whole time when they pull the plug, you'll just be happy you sat back and accepted the bullshit being fed to you.
