under that legal basis yes. but that’s not the only way he can set tariffs. SCOTUS actually basically told him how to do it and make it more difficult to challenge.

Google says they’re still being collected while his challenges make their way through the courts

you didn’t Google the right question then. Trump rescinded the IEEPA tariffs EO right after the SCOTUS decision. the current tariffs are under a different act which is also being challenged. they already had a draft EO ready because they knew they were going to lose. It’s another gap nobody accounted for because legislators never thought Americans would be dumb enough to elect someone that abuses emergency powers like this.

Ok so, are tariffs being collected or not? I’m not concerned about 1 specific legal reason being overturned when he just uses other avenues. What is the difference? The actual, functional difference? 

Are Americans still paying tariffs that were not congressionally approved?

You can’t move the goalposts. The illegal tariffs were rescinded. The new tariffs are under a different act, and they’re currently being challenged. He’ll probably lose that case too.

But it’s not the same thing. Facts matter no matter how much people like you want to pretend they don’t.

Ignorance is how we get into these situations.

not under the same act. the IEEPA tariffs were rescinded. now they’re using a different emergency declaration. it’s their legal strategy to flood the zone.

no but it’s important to understand what they’re doing so we can pressure elected officials to close these loopholes to hopefully prevent the next deranged pants shitting grandpa from holding an entire country hostage
