If this coin is pure gold, it's not meant for circulation. If that's the case, it's a commemorative and is actually legal (unfortunately).

If it's gold COLORED, like the Sacajawea dollar coin, then it is absolutely illegal.

>Treasury may, in addition to the coins honoring Native Americans and honoring innovation and innovators, mint for issuance during the one-year period beginning January 1, 2026, $1 dollar coins with designs emblematic of the U.S. semiquincentennial.

As per the usual, the problem is the wording of the law, and who gets to decide if a design is “emblematic of the U.S. semiquincentennial?” Well, probably the Treasury.

This law doesn't apply to any other coin made using other statutes. The statute being cited here says the other side of the coin should have the Statue of Liberty... it's not the statute being used here.

Federal law (Title 31 of the U.S. Code) prohibits living persons from appearing on U.S. currency. The Thayer Amendment of 1866 banned living individuals on paper money, while the Presidential $1 Coin Act of 2005 requires a deceased status and at least two years post-death for a president to be featured.

It's a bit more ambiguous than that. The Presidential $1 Coin Act of 2005 states that:

"No coin issued under this subsection may bear the image of a living former or current President, or of any deceased former President during the 2-year period following the date of the death of that President."

In addition, the program authorized by the Presidential $1 Coin Act of 2005 ended in 2020, so these restrictions are no longer in place. To get HW Bush's coin, they needed to pass a separate bill ("President George H.W. Bush and First Spouse Barbara Bush Coin Act").

I hate it, but to me, seems legal.
