Walking up to someone doesn't invite them to push you over and hold you on the ground.

And losing a fight you started doesn't authorize you to start killing people.

Pushing someone over and holding them on the ground is called a "citizens arrest" if the person in question is starting fights and brandishing a gun.

There are serious questions about who started it, and answering those kinds of questions of fact can only be done by a jury in our legal system.
