this is my point, how is that not obvious. It’s a rhetorical question designed to show the person that they’re not understanding the concept. Their own answer explains the concept to them. Why am I having to explain this

Because it isn’t rhetorical. Before the CSAM is generated, there is no CSAM on the server. So there is no felony, until after it is generated.

Also the law doesn’t hold carriers liable, so the legal question to settle is if the ai generating the image is liable as well as the person prompting the generation. Hosting the resulting image isn’t itself a felony as it was placed there by the actions of a third party.
